All PARTICIPANTS MUST READ AND AGREE TO COMPLETE THIS LEGAL WAIVER :-

I hereby acknowledge that I am voluntarily participating in sports activities organised by Smeda Sports Ltd.

I understand that these activities involve inherent risks, including but not limited to bodily injury, property damage, and death, which may occur as a result of my participation.

Therefore, I agree to the following terms:

  1. RELEASE AND WAIVER OF LIABILITY:

I hereby release and forever discharge the Smeda Sports Ltd, Smeda Pickleball Smeda Padel its directors, officers, agents, employees, and volunteers (collectively, the “Released Parties”), from any and all liability, claims, demands, and causes of action that I may have now or in the future, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise.

  1. ASSUMPTION OF RISK:

I understand and acknowledge that my participation in the sports activities namely Smeda Pickleball Smeda Pickleball organised by the Smeda Sports Ltd involves inherent risks, including but not limited to bodily injury, property damage, and death. I voluntarily assume all risks associated with my participation in these activities.

  1. INDEMNIFICATION:

I agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, and causes of action, including solicitors’ fees and costs, arising out of or related to my participation in the sports activities organised by the Smeda Sports Ltd.

  1. MEDICAL TREATMENT:

I authorise Smeda Sports Ltd, its agents, employees, and volunteers, to obtain or provide medical treatment for me or my child in the event of any injury, illness, or other medical condition that may occur during my participation in the sports activities.

  1. REPORT ACCIDENTS / INJURIES:-

I provide consent to report accidents / injuries to Smeda Sports Ltd, its agents, employees, and volunteers in order to comply with the Health and Safety Act and RIDDOR at the various venues that we play pickleball at.

  1. PHOTOS, VIDEOS, SOCIAL MEDIA:

I consent to participating and understand that on occasion videos or photos maybe taken during a session which may be posted on social media in order to promote the sport. I agree to inform session leaders if I DO NOT CONSENT TO THIS DURING A PICKLEBALL OR PADEL SESSION

  1. ACKNOWLEDGEMENT OF UNDERSTANDING:

I have read this sports waiver, fully understand its terms, and understand that I am giving up substantial rights, including my right to sue the Released Parties for any injury, death, or damages that may result from my participation in the sports activities organised by the Smeda Sports Ltd, Smeda Pickleball, Smeda Padel.

  1. DECLARATION OF FITNESS:

I confirm that I am fit and healthy to take part in Pickleball / Padel Sessions, I will tell Smeda Sports Ltd, its agents, employees, and volunteers if I have a Serious medical condition and will participate at my OWN RISK.

  1. CORRECT CLOTHING FOOTWEAR EYE PROTECTION :

I agree to wear the correct clothing, footwear and protective eye wear for health and safety purposes.

  1. FIRST AID MEDICAL TREATMENT:

I agree to any first aid / medical treatment that I may require in an emergency.

I also agree to disclose any existing injuries or Serious Medical conditions.

Smeda Sports Ltd will not disclose any personal information in line with the GDPR guidelines. 

  • I am agreeing to Smeda Sports Ltd, keeping an electronic record of this form for health safety and emergency reasons.

I also agree to read our Member Privacy Policy, Terms and Conditions, Code of Conduct and Membership Terms and Conditions.

Smeda Sports Ltd can update these policies at any time.Ag
